Travel business in Thailand is guided by ‘Tourism Business and Guide Act 2008’. As per the act Tourism Business means “a business relating to guiding tourists for touring or for other purposes of travelling by providing either one or several services or conveniences such as lodging, food, guide or any other services.”  The tourism business operator cannot act as an agent the services offered should be directly to end users or tourists.

As stated by Foreign Business Act 1999, tourism business is restricted for foreigners, if foreigner wants to do tourism business in Thailand then Thai Private limited company is a viable option and private limited company as a juristic person can apply for the required license.

Classification of Tourism Business License

Tourism authority has classified Tourism Business License into four different types based on scope of operation

1. Local Tour Business License /specific area license:

This type of license allows you to conduct your business within any province and its adjoining provinces.

2. Domestic Travel Business License:

This type of License allows you to conduct your business within Kingdom of Thailand

3. Inbound Travel Business License:

This type of License will facilitate for conducting tourism business by guiding tourist from foreign country to travel within the kingdom of Thailand.

4. Outbound Travel Business License:

This type of License enables your business to conduct tourism business within the Kingdom and abroad. An applicant for this type of license may conduct other type of tourism business as well without having apply for separate license.  

Legal provision for the application of Tourism License:

If a natural person applies for any type of tourism business license he/she should have following fundamental qualification

1. Being not less than 20 years of age on an application date
2. Being of Thai nationality
3. Being domiciled or resided in the Kingdom of Thailand
4. Not being bankrupt or under receivership
5. Not being a person, of unsound mind, mental infirmity, incompetency
6. Not being a person, whose tourism business license is on suspension
7. Not being a person, whose tourism business license has been revoked

In case of Juristic person, the company should have following basic qualification

1. Being the juristic person under Thai law with objective specifically defined as to operate business concerning tourism business.
2. If juristic person is partnership then partner having unlimited liability or managing partner should a a Thai national or if juristic person is limited liability company then at least 51% of the company’s share should be held by natural person who has Thai nationality.
3. More than half of limited liability company’s directorship should comprise of Thai nationals.

List of documents for application of tourism business license

1. Certificate of registration
2. Company affidavit along with shareholder list
3. Copy of ID card of signatory Thai director
4. Copy of House registration of signatory Thai director
5. Copy of memorandum of association and by law of the company
6. Two company seal
7. Two pictures taken in front of the place of business with 7.6 x 12.7 centimeter in size
8. Map demonstrating a location of the place of business
9. Ownership or possessory right of the establishment operated as business place
10. A copy of insurance policy.

Security deposit and fee

Local Tour Business License /specific area license
Security deposit of 10,000 Thai Baht with application government fee of 2,000 Thai baht

Domestic Travel Business License
Security deposit of 50,000 Thai Baht with government fee of 2,000 Thai baht

Inbound Travel Business License
Security deposit of 1,00,000 Thai Baht with government fee of 2000 Thai Baht

Outbound Travel Business License
Security deposit of 2,00,000 Thai Baht with government fee of 2000 Thai Baht.
The security deposit can be presented in the form of bank guarantee or cash or Thai government bond, state owned enterprise bonds. The license is granted for the period of 2 years and has to be renewed every two years.

It is highly recommended to initiate license renewal process at least 120 days before its expiry.
