Foreign investors can incorporate company under 100% foreign ownership under following criteria as set by Ministry of commerce

Board of Investment

Board of investment certified company can enjoy upto 100% foreign ownership, corporative tax incentives, merit based incentives and other exemption as approved by Board of Investment.

Thailand – US treaty of Amity company

The treaty allows for American citizens and businesses incorporated or in Thailand to maintain a majority shareholding or to wholly own a company in Thailand, and thereby engage in business on the same basis as would a Thai national. These companies are also exempt from most of the restrictions on foreign investment imposed by the Thai Foreign Business Act of 1999.

Foreign Business License

You can apply for the 100% ownership of your business to the ministry of commerce sighting your venture’s contribution to the economy in terms of technology and know-how transfer, creation of jobs in local economy and investment and other director and indirect economic contribution.
